What Is A Full Title Guarantee?

They are commonly referred to in conveyancing documents such as the Contract for Sale.
So, if you are buying or selling a property it’s important you know what a full title guarantee is. In this blog post we look at what a full title guarantee is. We also shate what it means for the purchase or sale of your home.
What Is A Full Title Guarantee?
When you sell or purchase a property with a Full Title Guarantee it means that the person has the right to sell the property. It also means that the seller will do all they do all reasonable things to ensure that buyer will acquire a good title to the property. This is done at the cost of the seller. When a property is sold as registered it is also presumed that the whole of the property in the registered title is being disposed of.
If the property that is being sold is a leasehold property, then additional covenants are implied. These include that the lease is still in existence. Also that the seller has complied with the terms of that lease. It is presumed that the interest in the freehold is also being sold when a property is sold as unregistered. However, if it is clear that the property is being sold as leasehold then it is presumed that the interest being sold is the unexpired term of the lease.
It is also presumed that the person is selling the property free from all mortgages. They are also free from other rights and interests which may be exercisable by a third party. This does not and could not cover those third parties that the seller could not reasonably be expected to know about.
