If the seller of the home has no personal knowledge of the property it will be sold under a Limited Title Guarantee. This is often the case for homes sold by an attorney for example. The executor of the property may also need to sell the property under this title guarantee too. A house that has been repossessed will need to sell the home with this title guarantee. The same for a home that is being sold by a trustee or personal representative.
In simpler terms, it means that the person selling the home can not guarantee it isn’t subject to any financial charges. This means that they can’t guarantee there are any rights over the property. It also means that they may not be able to five any information on what these rights may be. The seller will also be unable to confirm if there are any covenants in place that may affect the property.
