- Instruction Forms
Our team will manage the early stages of the house buying transaction for you. They will prepare a fee estimate for you and issue you with the terms of business. You will need to read and sign these forms. They will need to be returned to us with ID. This will allow our formalities and legal requirements to be met. By completing these forms in a timely manner, we will be able to offer quick progression of your property purchase.
- Contract of Sale
The contract of sale is a document that outlines the terms and conditions that have been agreed between you and the seller. It will include details about the slae price, completion date and a description of the property to. This contract is really important because our conveyancer will use it throughout the exchange process. It formalises the transaction (purchase of the house) and sets out the completion date.
- Transfer Deed
The transfer deed is a legal document that will transfer the legal title from the seller to the buyer. It is sent to the Land Registry to register the transaction. If there are any additional right or provisions with regards to the transaction, these will be detailed in the transfer deed document too. Each document will need to be signed by both parties. A witness from an independent party will need to witness the signatures too.
- Mortgage Deed
If the house purchase is being financed by a mortgage, then the mortgage deed is another of the forms that need to be signed during the conveyancing process. The mortgage deed binds you to the terms of the mortgage offer. It also secures the mortgage on the property on completion.
- Stamp Duty Declaration
It is likely that you will be liable to pay Stamp Duty Land Tax when purchasing land. You can instruct your conveyancing lawyer in Peterborough to submit this to HMRC on your behalf. If you choose to do this, you will be required to sign a declaration. This will confirm the details of the transaction. It will also lay out any amount of tax payable.
